Stuck in "In Progress"?

Application Stuck?
No Decision, No Timeline.

If your Canadian immigration application has been "in process" for months or years with no meaningful progress, you may not need to simply wait. We use Mandamus to force IRCC to do their job.

Important: Mandamus does not order IRCC to approve your application. It requires them to decide your file within a reasonable time.

Takes about 60 seconds · No account, no payment · Not legal advice

Leave blank to use IRCC's current posted time.
We'll email you a copy of your readiness result. We won't share your email.
This tool gives general information based on published Federal Court decisions and IRCC's public processing-time data. It is not legal advice and does not create a lawyer–client relationship. Whether mandamus is appropriate depends on the full facts of your file, and outcomes vary - past results do not guarantee future ones.
Legal Definition

What is Mandamus?

Mandamus is a type of judicial review where we ask the Federal Court to order a decision-maker (IRCC) to carry out a legal duty they are avoiding.

It is not a shortcut or a guarantee of a positive result. The Court will not replace IRCC's decision with its own. Instead, it asks:

"Has IRCC taken too long to decide this application, in a way that is unfair, unreasonable, or inconsistent with its obligations?"

Assessment Factors

Is My Delay Unreasonable?

Not every delay is illegal. When I assess a file, I look at these factors:

  • 1
    Duration

How far are you beyond IRCC's own published processing ranges?

  • 2
    Complexity

Is it a straightforward renewal or a high-risk security case?

  • 3
    Prejudice

Are you losing job offers, missing school start dates, or facing family separation?

  • 4
    What You Tried

Have you sent Webforms, MP inquiries, or requested GCMS notes?

Want a first read on these factors right now? The free Mandamus Readiness Check on this page runs the same comparison against IRCC's posted times and real Federal Court decisions.

When Does Mandamus Make Sense?

✓ Good Candidates

  • Permanent residence applications well beyond normal timelines.
  • Study/Work permits where start dates or job offers are passing.
  • Citizenship applications stalled for years after passing tests.
  • Cases where IRCC says "everything is complete" but gives no timeline.

× Usually Not Appropriate

  • Application is still within normal/posted processing times.
  • You have missing documents or haven't done biometrics.
  • There are clear reasons for delay (e.g. litigation in other tribunals).
  • You want the Court to approve the visa directly.

How The Mandamus Process Works

The goal is to get a decision - not to fight over a refusal that hasn't happened yet.

1. Assessment & Demand

We review your history and determine if the legal test is met. In appropriate cases, we send a detailed demand letter putting IRCC on notice and asking for a decision.

Success: Often, this letter alone unstucks the file.

2. Federal Court Application

If there is still no progress, we file an Application for Leave and for Judicial Review. This assigns a Department of Justice lawyer to your file.

3. Resolution or Hearing

Many cases resolve via Consent Order (settlement) where IRCC agrees to a specific deadline. If not, we proceed to an oral hearing.

Frequently Asked Questions

Will IRCC "punish" me for going to Court?

This is a common fear, but Mandamus is a lawful remedy. Applicants use it routinely. IRCC is expected to act lawfully. In my experience, proper mandamus applications are treated as part of the normal legal process, not personal attacks.

Will mandamus force IRCC to approve my application?

No. Mandamus forces a decision, not an approval. However, getting a decision (even a negative one that we can then challenge) is often better than being stuck in limbo indefinitely.

Do I have to try other options before mandamus?

Usually, yes. We need to show the Court you tried reasonable alternatives (Webforms, MPs). We will review what you've done during our assessment.

How long does it take?

Some matters resolve quickly after the demand letter. Others proceed through the leave process. We will give you realistic timeframes based on your specific case type.
